Provides Employment Protections for Drug Tests for Medical Marijuana Patients

Summary
Prohibits any employer from firing or refusing to hire an employee that is a registered medical marijuana patient based on testing positive for marijuana on a drug test. This does not include any job that someone is applying for that working while under the influence of medical marijuana creates an unreasonable safety risk or if the conduct of the employee “falls below the standard of care normally accepted for that position.”
The bill also allows any person who suspects a violation of this provision to bring a civil action in court within 180 days of the alleged employment discrimination.
